Terms of Service

These Terms of Service ("Terms") govern your use of the PranaVeda website, mobile applications, and all related services (collectively, the "Services") operated by PranaVeda Wellness Pvt. Ltd. ("PranaVeda," "we," "us," or "our"). By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Acceptance

By accessing or using the Services, you confirm that you are at least 18 years of age, or that you are at least 13 years of age and have obtained verifiable parental or guardian consent. If you are using the Services on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

We may update these Terms from time to time. We will notify you of material changes by posting a notice on our website or sending an email to the address associated with your account. Your continued use of the Services after such notice constitutes acceptance of the revised Terms.

2. Service Description

PranaVeda provides an online wellness platform offering live and on-demand yoga classes, meditation sessions, breathwork courses, nutrition guidance, and related health and fitness content. Our Services include:

• Live-streamed and pre-recorded video classes taught by certified instructors
• Personalised practice recommendations based on your goals and history
• Progress tracking and wellness dashboards
• Community features such as class chat and discussion forums
• Nutrition plans and meal suggestions (not medical advice)

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, including the availability of any feature, content, or class, with reasonable notice where feasible.

3. User Accounts

To access premium features, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately at security@pranaveda.com if you suspect unauthorised use of your account

You may not create multiple accounts for the purpose of abusing free trials, nor may you share your account credentials with others. We reserve the right to suspend or terminate accounts that violate these requirements.

4. Payment

Certain features of the Services require a paid subscription. By subscribing, you agree to the following:

• Pricing: Subscription fees are displayed on our pricing page before you subscribe. We reserve the right to change pricing with 30 days' advance notice. Existing subscribers will be charged the new rate at their next renewal date.
• Billing Cycle: Subscriptions are billed in advance on a monthly or annual basis, depending on your selected plan. Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date.
• Payment Methods: We accept major credit and debit cards, UPI, and PayPal. You are responsible for maintaining a valid payment method on file. Failed payments may result in suspension of premium access.
• Taxes: All prices are exclusive of applicable taxes unless stated otherwise. You are responsible for any taxes imposed on your subscription.

We use third-party payment processors to handle your financial data securely. PranaVeda does not store full credit card numbers on its servers.

5. Cancellation

You may cancel your subscription at any time through your account settings or by contacting our support team. The following terms apply:

• Effective Date: Cancellation takes effect at the end of your current billing period. You will retain access to premium features until then.
• No Partial Refunds: We do not provide prorated refunds for the unused portion of a billing period, except as required by applicable law or as outlined in our Refund Policy.
• Free Trial: If you cancel during a free trial, you will not be charged. Access continues until the trial period ends.
• Data Retention: After cancellation, your account data is retained for 90 days. You may request earlier deletion by contacting us. After 90 days, your data may be permanently deleted.

We reserve the right to cancel or suspend accounts that violate these Terms, engage in fraudulent activity, or are inactive for more than 12 consecutive months.

6. Liability

Our Services provide general wellness and fitness content. We are not a medical provider, and our classes, nutrition plans, and other content are not intended as medical advice, diagnosis, or treatment. You should consult a qualified healthcare professional before beginning any new exercise or nutrition program, especially if you have pre-existing health conditions.

To the fullest extent permitted by law:

• PranaVeda provides the Services "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• PranaVeda shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, even if we have been advised of the possibility of such damages.
• Our total cumulative liability to you for any claims arising out of or relating to the Services shall not exceed the total amount you paid to PranaVeda in the 12 months preceding the claim.

You agree to indemnify and hold harmless PranaVeda, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services or violation of these Terms.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to their conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.

Before filing any formal legal claim, you agree to attempt to resolve the dispute informally by contacting us at legal@pranaveda.com. We will attempt to resolve the dispute within 60 days. If we cannot, you or we may proceed with formal legal action.

If any provision of these Terms is held to be unenforceable or invalid, that provision will be changed and interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
